Mgenge True rapper has threatened to sue social media influencer, Brain Mutinda, and an electronics company, Syinix Electronics, for copyright infringement.
According to Nonini, the company used one of his songs in an advertisement video without his consent. The business used Nonini’s song “Wekamu” synchronized in a video promoting one of their products in a video
The legendary musician threatened to sue Synix for copyright infringement in a letter addressed to them.
Nonini claimed that the firm and the influencer each appropriated his song for commercial and personal advantage.
“In this case, the influencer under the engagement of Syinix Electronics used our client’s copyrights for his own financial gain and for Syinix Electronics’ capitalistic gain without permission of our client hence amounting to copyright infringement,” the letter read in part.
The rapper insists that the right channels were not followed before the company and the influencer decided to use the song in one of their videos.
“A synchronization license is required no matter how small a portion of the song you use especially for commercial purposes. If a song is synced on a video you will need to pay the composer of the song no matter how small the portion of the composition is used,” he said.
Nonini took to social media to warn the company and urged it to take down the clip and issue a public apology. The rapper is demanding that the influencer and the company publicly apologize to him on the same channels that the video was shared.
Nonini revealed that the video was shared on a verified Facebook page and the influencer’s Instagram page. He further said that he will take legal action against the electronics company for copyright violations.
“Should you choose to ignore this demand, we have mandatory unequivocal instruction from our client to institute legal proceedings against both of you in a court of law,” the letter further read.
This comes barely two months after Kenyan boy band, Sauti Sol accused Azimio la Umoja of copyright infringement. According to Sauti sol, they did not authorize Azimio la Umoja to use one of their songs, Extravanganza in a video that unveiled Martha Karua as the running mate to former prime minister Raila Odinga.
