A Ugandan court has ordered the administrator of a WhatsApp group to reinstate a member who had been ejected from the group.
The court ruling came after Herbert Baitwababo filed a lawsuit challenging his removal from the ‘Buyanja My Roots’ WhatsApp group by its administrator, Allan Asinguza.
Baitwababo told the court that the WhatsApp group was formed for members of the Buyanja sub-county in Rukungiri district to contribute to charity works, offer condolences, and support each other.
Each member was required to pay a Sh.30,000 (approx. Ksh.1,000) membership fee.
Baitwababo said that he was removed from the WhatsApp group after he asked Asinguza about the process that allowed them to manage the group’s affairs, as well as an audit report and accountability for funds collected since the group was formed in 2017.
The court found that Baitwababo’s removal from the WhatsApp group was a violation of his right to freedom of association.

The court ordered that Baitwababo be reinstated to the group and that Asinguza be restrained from further infringing on Baitwababo’s right of association.
The court’s ruling is a reminder that WhatsApp group administrators have a responsibility to respect the rights of their members.
Group administrators cannot remove members simply because they disagree with them or because they ask questions about the group’s finances.
The ruling is also a victory for Baitwababo, who was able to use the legal system to protect his right to freedom of association.
