A former doctor working with the Homa Bay County Government has been forced to return Ksh 5.8 million after it emerged he was receiving salaries from two employers at the same time a serious breach of Kenya’s leadership laws.

The Ethics and Anti-Corruption Commission (EACC) confirmed the recovery on Friday, July 18, following a court ruling that declared the payments illegal.

Justice Musyoki of the Milimani Anti-Corruption Court gave the ruling on July 11, 2025. The judge found the doctor guilty of holding two full-time jobs, one at Homa Bay County and another as Branch Manager at Avenue Healthcare in Kisumu from August 2017 to August 2020.

The court ordered that all salaries paid to him during that period must be returned to the government, including interest.

Investigations by EACC revealed that the doctor violated Article 77(1) of the Constitution and Section 26 of the Leadership and Integrity Act, which bar public servants from engaging in other gainful employment while on full-time public duty.

“This is a clear misuse of public resources and a betrayal of public trust,” the Commission stated.

The court not only ordered the refund but also gave EACC full cost compensation for the legal process. According to the commission, the ruling is part of a wider effort to ensure that government officers remain accountable and ethical in handling public resources.

“This judgment sends a strong message to all county officials and public servants,” the statement read. “Public funds must be protected, and misconduct will not go unpunished.”

The doctor now faces financial consequences after he attempted to benefit from two salaries ended in a court order demanding full repayment, a reminder that integrity in public service is non-negotiable.
