South African opposition figure Julius Malema has been sentenced to five years in prison after being found guilty of unlawful possession of a firearm and discharging it in a public space.

The ruling was issued at the East London Magistrate’s Court, where Magistrate Twanet Olivier stated that the actions were not accidental but formed part of a deliberate incident.

The court maintained that the behaviour posed a serious risk to public safety, forming the basis of both the conviction and the sentence.

The case originates from events in 2018 during the fifth anniversary celebrations of the Economic Freedom Fighters in the Eastern Cape.

During the gathering, Malema was captured on video firing a semi-automatic rifle into the air while addressing supporters. The footage later circulated widely, triggering legal scrutiny and public debate.

He was ultimately convicted on several charges, including unlawful possession of ammunition, reckless endangerment, and discharging a firearm in a public place.

In his defence, Malema maintained that the weapon did not belong to him and argued that the act was meant to energise the crowd during the political event.

However, the court dismissed these claims, ruling that the circumstances still amounted to unlawful and dangerous conduct regardless of intent.

Magistrate Olivier emphasised that the action could not be classified as spontaneous, reinforcing the severity of the judgment.

Following the sentencing, Malema’s legal team moved quickly to lodge an appeal, which has temporarily suspended the enforcement of the prison term.

This means he will not be taken into custody immediately as the case proceeds to a higher court for review.

The outcome of the appeal could determine whether the sentence is upheld or overturned, with significant legal and political implications.

The ruling now places fresh attention on Malema’s political standing, as the sentence, if confirmed, could affect his role as a Member of Parliament.

Julius Malema has long been one of South Africa’s most outspoken political leaders, known for his radical economic messaging and strong public rallies.

The case was initiated through a private prosecution by AfriForum after the controversial video resurfaced and gained traction online.

With the appeal process now underway, the final decision will rest with a higher court, which will determine whether the conviction and five-year sentence remain in force.

For now, the case continues to draw intense political attention, as supporters and critics wait for the next chapter in a saga that blends law, politics, and public controversy.
