The Orange Democratic Movement has announced it will take former Deputy President Rigathi Gachagua to court after he accused the party of planning to rig the Magarini by-election.
ODM Deputy Party Leader Abdulswamad Nassir said Gachagua was using the claims to stay politically relevant, dismissing him as “a former disgraced Deputy President trying to force his way back into the news.”
Nassir added that allegations that Kilifi Governor Gideon Mung’aro was using county money to support the ODM candidate were completely false.
Governor Mung’aro has already instructed his lawyers to act. A formal demand letter has been sent to Gachagua, directing him to retract and apologise for the allegations.
The letter outlines a point-by-point rebuttal, including a detailed schedule meant to prove that claims of meetings with senior IEBC officials were fabricated.

Nassir said ODM remains calm and confident, arguing that the opposing camp had already “felt the ground shift” and was now turning to drama instead of campaigning.
“They have sensed defeat. This is pure political theatrics.”

He urged ODM supporters to stay peaceful and come out in large numbers on voting day.
ODM has also appealed to state agencies to maintain order and provide a transparent process, noting that tension is rising as the by-election approaches.
The dispute now sets the tone for a highly charged by-election, with legal battles and political messaging running side by side.
