Thika, Kenya, A woman who refused to take a test after being pulled over by police on suspicion of drunk driving has been fined KSh 20,000 by a Thika court.
The accused, Mary Onyango, was arrested on June 23, 2025, in the Gatitu area while driving a Mitsubishi Pajero. Police flagged her down for suspected intoxication, but she declined to cooperate.
According to the charge sheet, Onyango failed to provide a breath specimen despite being clearly instructed by traffic officers, a direct violation under Kenya’s road safety laws.
Prosecutors argued that officers had every reason to believe she had consumed alcohol, but she refused to follow instructions to undergo the required test.
In court, Onyango admitted the offence. She pleaded guilty and apologised, telling the magistrate that she regrets her actions and promised to follow the law moving forward.
While delivering the sentence, the magistrate acknowledged her remorse, but emphasised that following instructions from traffic officers isn’t optional.
“When it comes to road safety, police orders must be obeyed,” the magistrate ruled.
As a result, the court fined Onyango KSh 20,000. If she fails to pay, she will serve an 8-month jail term as an alternative punishment.
