A petition by Officer Commanding Station (OCS) Samson Talaam, who is trying to block his prosecution, has now been moved to the Kibera High Court. Justice Lawrence Mugambi approved the transfer this morning, saying it was necessary to keep court decisions consistent.

State Counsel Jalson Makori had asked Milimani to hand over the case, arguing that Talaam’s petition came before charges were formally filed. Now that he has already taken a plea in Kibera, Makori said continuing the case at Milimani no longer made sense.

Justice Mugambi agreed with the DPP’s position. He said keeping the matter at Milimani could create legal confusion, since the Kibera court already has full authority over Talaam’s prosecution.

He added that any concerns about Talaam’s detention or charges should be addressed before Justice Diana Kavedza, who’s already managing the trial in Kibera. Mugambi ruled that the entire file be moved for further directions under her watch.

OCS Talaam is one of several officers linked to the alleged torture and killing of blogger Albert Ojwang in police custody. The case has sparked nationwide anger and renewed pressure for real accountability within the police service.
