High Court Denies Sarah Wairimu Cohen Bail in Tob Cohen Murder Trial

The High Court in Nairobi has denied Sarah Wairimu Cohen bail, citing concerns about witness intimidation in the ongoing murder trial of her late husband, Tob Cohen.

Lady Justice Diana Kavedza ruled on Tuesday that the prosecution had presented strong evidence of possible witness interference. She emphasized that justice and public interest outweighed Wairimu’s right to liberty at this stage.

Murder Allegations and Legal Proceedings

Wairimu is accused of murdering Dutch businessman Tob Cohen on July 19, 2019, at their Lower Kabete home in Nairobi.

She was re-arrested after the Director of Public Prosecutions (DPP) Renson Ingonga reviewed the case and confirmed there was sufficient evidence to charge her with murder.

The case will be mentioned on February 26, 2025, for pre-trial directions.

Cohen’s Family Opposes Wairimu’s Access to Property

Meanwhile, Cohen’s family has requested the court to bar Wairimu from accessing his home on Farasi Lane, where his body was discovered in a septic tank.

Advocate Pearlyne Omamo, representing Cohen’s estate, argued that allowing her back into the property would be a miscarriage of justice as it remains a crucial crime scene.

She further stated that despite a 2019 court order barring Wairimu from the house, she had managed to gain access under unclear circumstances.
