Kenyan musician Nonini has responded to claims made by producer Clemmo demanding a cut in the rapper’s KSh 1 million awarded from a copyright infringement suit.
Last Friday a Milimani Commercial Magistrate ruled in Nonini’s favour, and the rapper was awarded KSh 1 million in general damages for copyright infringement after against TikToker and influencer Brian Mutinda used we Kamu song in his promotional videos.
The influencer was also directed to pull down the promotional video from his social media pages. Reacting on the news, Clemmo who produced the song said he was supposed to have a share as he was the brains behind the music track that had been used for a promotional video.
In a statement, Nonini addressed the issue by stating:
“Ignorance can indeed be bad sometimes. Yes, I am aware that every citizen has the right to appeal any court decision as per our constitution, but it is important to follow the due process of the law. Reading things online can sometimes make one look foolish.”
Nonini acknowledged the importance of proving one’s case through facts rather than relying on emotional outbursts on social media, saying:
“If you feel that your rights were infringed, you are at liberty to open a suit against the influencer and the company. However, it’s important to note that the court system is about facts, not emotional outbursts on social media. You need to prove your case, and I have invested my time and resources in the suit, which you can also do the same. This matter requires diligence, are we clear?”
Nonini also emphasized the need to focus on the matter at hand and not get sidetracked by petty issues, saying:
“Let’s not go down that petty road. We can focus on the matter at hand. There is a mention about this case tomorrow, and I need to concentrate on that.”
Nonini’s comments indicate a commitment to following due process and relying on facts to address legal matters. It remains to be seen how this issue will be resolved.
