Football Kenya Federation(FKF) president Nick Mwendwa will take plea on Monday at Kiambu Law Courts after the High Court on Wednesday declined to bar the Director of Public Prosecutions (DPP)from charging him afresh.
Lady Justice Esther Maina said she has no jurisdiction to stop the DPP from charging the FKF boss and directed that the file be transferred to the Kiambu High Court as she lacks Jurisdiction to entertain the petition.
Mwendwa had been charged over conspiracy to defraud the federation over Sh38m and he has been attempting to clear his name.
The FKF boss was ousted from office on November 11, 2021 by Sports Cabinet Secretary Amina Mohamed but regained control of Kandanda House on Tuesday in a brief ceremony that was attended by members of the federation and the media.
On July 6, the case was withdrawn under Section 87 of the Penal Code but the DPP would then charge Mwendwa afresh at Kiambu Law Courts a day later.
Mwendwa would then obtain a court order from the High Court to stop any fresh charges against him.
The FKF boss will now know whether the fresh charges filed against him are legal and constitutional or not on Monday.
